Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Whissle mobile application and web application at lulu.whissle.ai (collectively, the "Service"), operated by Whissle ("we," "our," or "us"). By using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you are at least 13 years old and agree to comply with these Terms. If you do not agree, you may not use the Service.

2. Description of Service

Whissle is an AI-powered personal assistant that provides:

• Real-time conversation coaching (Live Assist)
• Voice-powered note-taking and transcription
• Deep research and web search synthesis
• Calendar and email management (via Google account integration)
• Memory and knowledge management
• Image generation and analysis
• Task planning and scheduling

Features may be added, modified, or removed at our discretion. We will make reasonable efforts to notify users of significant changes.

3. User Accounts & Device Identity

• The Service uses a device-based identity system. Your data is associated with a unique device identifier generated on first use.
• You are responsible for maintaining access to your device. If you lose your device or clear app data, your locally-stored identifier may be lost.
• You may optionally link a Google account for calendar and email features. You can revoke this access at any time.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Record or transcribe conversations without the consent of all participants where required by law
• Generate, store, or distribute harmful, abusive, defamatory, or illegal content
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Interfere with or disrupt the Service or its infrastructure
• Use automated means (bots, scrapers) to access the Service beyond intended use
• Impersonate another person or entity
• Circumvent any access controls or usage limits

5. Voice Recording & Consent

The Live Assist and Voice Notes features record audio from your device's microphone. You are solely responsible for ensuring that you have obtained any necessary consent from other parties before recording conversations. Recording laws vary by jurisdiction — some require all-party consent. Whissle is not responsible for your compliance with local recording laws.

6. AI-Generated Content

• The Service uses artificial intelligence to generate responses, research summaries, suggestions, and other content.
• AI-generated content may contain inaccuracies, outdated information, or errors. You should independently verify any important information before relying on it.
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content.
• AI-generated content does not constitute professional advice (legal, medical, financial, or otherwise).

7. Intellectual Property

• The Service, including its design, code, AI models, and branding, is owned by Whissle and protected by intellectual property laws.
• Content you create using the Service (notes, research, recordings) remains yours.
• You grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service.

8. Third-Party Services

The Service integrates with third-party platforms including Google (Calendar, Gmail, Drive), AI providers (Google Gemini, Anthropic Claude), and others. Your use of these integrations is subject to the respective third-party terms and privacy policies. We are not responsible for the availability or conduct of third-party services.

9. Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted access to the Service.
• The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
• We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time.

10. Limitation of Liability

To the maximum extent permitted by law, Whissle shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising from your use of or inability to use the Service.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
